1. ACCEPTANCE OF TERMS

By accessing, browsing, or using the Tattit platform ("Platform"), mobile applications, or any services provided by Tattit ("we," "us," or "our"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR PLATFORM.

2. PLATFORM ROLE - MARKETPLACE ONLY

2.1 Limited Role

Tattit's role is strictly limited to:

• Providing a platform for artists to showcase portfolios
• Enabling clients to browse artist profiles
• Facilitating initial contact between parties
• Providing messaging tools for communication

2.2 No Agency Relationship

Tattoo artists on our Platform are independent contractors, NOT our employees, agents, or representatives. We do not control, and are not responsible for, the quality, safety, legality, or availability of tattoo services provided by artists.

3. USER ELIGIBILITY & ACCOUNTS

3.1 Age Requirements

• Platform Use: You must be at least 18 years old
• Tattoo Services: You acknowledge that tattoo age requirements vary by jurisdiction
• Parental Consent: Minors seeking tattoos must comply with local laws regarding parental consent

3.2 Account Responsibilities

You are responsible for:

• Providing accurate, truthful information
• Maintaining account security and confidentiality
• All activities under your account
• Immediately notifying us of unauthorized access

3.3 Artist Verification

While we may implement verification processes, we DO NOT guarantee the qualifications, licenses, skills, or legal compliance of any artist. Users must independently verify artist credentials.

4. ASSUMPTION OF RISK - TATTOO SERVICES

4.1 Known Risks

You acknowledge that tattoos involve risks including but not limited to:

• Allergic reactions to inks or materials
• Infections (including bloodborne pathogens like HIV, Hepatitis)
• Scarring, keloids, or granulomas
• MRI complications
• Dissatisfaction with artistic results
• Psychological regret
• Need for removal or cover-up procedures
• Complications from improper aftercare

4.2 Your Responsibilities

You are solely responsible for:

• Researching and selecting appropriate artists
• Verifying artist licenses and certifications
• Ensuring studio compliance with health regulations
• Disclosing medical conditions or medications
• Following aftercare instructions
• Seeking medical attention for complications

5. COMPREHENSIVE LIABILITY WAIVER

6. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Tattit and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including attorney's fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Any tattoo services you receive or provide
• Any dispute between you and other users
• Your negligence or willful misconduct

7. PROHIBITED CONDUCT

You agree NOT to:

• Misrepresent qualifications, licenses, or certifications
• Provide false health or safety information
• Engage in unlicensed tattoo practice
• Violate health and safety regulations
• Harass, threaten, or discriminate against others
• Post inappropriate, offensive, or illegal content
• Use the Platform for any unlawful purpose
• Attempt to circumvent Platform fees
• Scrape, mine, or harvest user data
• Interfere with Platform operations

8. HEALTH & SAFETY DISCLAIMERS

8.1 No Medical Advice

Nothing on our Platform constitutes medical advice. Always consult healthcare professionals regarding tattoo safety, especially if you have medical conditions, take medications, or have concerns about allergies or infections.

8.2 Compliance with Laws

Users are responsible for compliance with all local, state, and federal laws regarding tattoos, including age restrictions, licensing requirements, and health regulations.

8.3 Bloodborne Pathogens

Tattooing involves exposure to blood and potential transmission of bloodborne pathogens. We do not verify or guarantee artist compliance with universal precautions or infection control protocols.

9. INTELLECTUAL PROPERTY

9.1 Platform Content

All Platform content, features, and functionality are owned by Tattit and protected by international copyright, trademark, and other intellectual property laws.

9.2 User Content

By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for Platform operations and marketing.

9.3 Tattoo Designs

We are not responsible for intellectual property disputes regarding tattoo designs. Users must ensure they have rights to any designs they request or create.

10. LIMITATION OF LIABILITY

11. DISPUTE RESOLUTION

11.1 Binding Arbitration

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, not through court litigation.

11.2 Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

11.3 Exceptions

You may pursue claims in small claims court if they qualify. Either party may seek injunctive relief in court for intellectual property violations.

12. DISCLAIMERS & WARRANTIES

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security or data protection
• Quality or safety of tattoo services
• Qualifications or licensing of artists

13. PRIVACY & DATA

Your use of the Platform is subject to our Privacy Policy. By using the Platform, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.

14. TERMINATION

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Platform ceases immediately.

15. GOVERNING LAW

These Terms are governed by applicable laws without regard to conflict of law principles. Any legal action must be brought in appropriate courts with jurisdiction.

16. SEVERABILITY

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. MODIFICATIONS

We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance of modified Terms.
